Follow the CIL process

Once we have received your Commencement Notice, and if payment is due, we will issue what is known as a demand notice (similar to an Invoice for payment). 

The demand notice will set out:

• a breakdown of the charges (including surcharges and late payment interest where applicable)
• the date you must pay the CIL by (in most cases, you'll have 60 days from the date of commencement)
• the amount due in each instalment (if instalments apply)
• the date each instalment must be paid by (if instalments apply)
• all the details required to pay the charge (including the payment reference which must be used to enable us to locate your payment)

Receipts for payment

Once you have made a payment, then it can take several working days for this to be brought to our attention. However, once we have located this payment, we will generate a payment acknowledgement or receipt and send this to you for your records. If fully settled, we will also remove the CIL charge from the Local Land Charges Register. 

If you have made a payment and have not received an acknowledgement within 21 days, then you can email us.

Non-payment of CIL sums

It is very important that you contact us if you consider that you cannot or will not be able to fulfil a CIL payment, so we can discuss potential repayment options. 

The council has a number of enforcement provisions within the legislation, which include (but are not limited to): 

• service of a CIL Stop Notice (which would to prevent further works occurring)
• imposition of Late Payment Surcharges (and mandatory Late Payment Interest)
• applications to Court for Liability Orders and Charging Orders
• in rare cases, prosecutions and prison sentences.
