There are several stages in the Community Infrastructure Levy (CIL) process. Find out if a development proposal is liable using our online guides.
If you have been issued a Liability Notice, then it is a requirement for you to tell us once you have established a commencement date for the works. The latest you can give this to us is 1day before you start work.
For physical building works, commencement would usually be considered to comprise demolition works and or the digging of foundations for the approved development (further clarification can be sought from the council on specific circumstances if required)
To inform us of the commencement date, download the Commencement Notice from the Planning Portal, complete it and then post or email it to us. We will then confirm receipt of the form, update our records and send you a Demand Notice (if a CIL charge is applicable).
Complete a Commencement Notice
It is not uncommon for developments to need to delay or change their intended commencement dates (for various reasons). If the date of commencement changes, thensend us a revised Commencement Notice, and we will correct and resend a new Demand Notice to you based upon the revised date.
If you do not send us a completed and correct Commencement Notice, but the council has reason to believe that works have begun, then the council may choose to ‘deem’ a commencement date based upon all available evidence at its disposal. You can appeal against a deemed commencement date. To do this, you need to appeal to the Planning Inspectorate within 28 days of the issue date on the Demand Notice (which is where the deemed commencement date will be stated).
